Konz, Kommlingen district: Initiation of the procedure according to Section 4 (1) of the Building Code - early public participation
In Kommlingen, large-scale housing projects, particularly in the form of apartment units, have been proposed and implemented at various locations in recent times. Similar construction projects could also be expected in the town center, given the deteriorating building fabric. These developments could pose planning challenges with regard to their dimensions, exterior design, the number of residential units, and the expected additional traffic volume. Therefore, a decision was made to implement appropriate countermeasures in a timely manner.
At its meeting on November 15, 2022, the City Council approved the establishment of a simple development plan and a change ban to safeguard the regional architectural culture and ensure uniform development. The public was informed of this for the first time on December 3, 2022. Subsequently, the spatial definition of the area of application was clarified and made public. To further counteract the ongoing developments, the change ban was extended for another year at the City Council meeting on November 12, 2024.
To ensure orderly urban development, the spatial definition of the scope of application was reviewed and discussed again. The definition of the new scope of application is intended to ensure that the planning objectives can be comprehensively achieved.
At its meeting on February 25, 2025, the City Council decided to implement early public participation by means of interpretation in accordance with Section 3 (1) of the Building Code (BauGB) and early participation of public interest groups in accordance with Section 4 (1) of the Building Code (BauGB), as the boundary line was recommended at the local council meeting on May 27, 2024.
The early public participation takes place in the time
from 7 April to 7 May 2025
in the form of a display at the municipal administration. The interested public has the opportunity to comment on the intended changes to the planning and to put forward suggestions. At the same time, the authorities (public interest bodies) are involved in the procedure pursuant to Section 4 (1) of the Federal Building Code (BauGB) by the commissioned office. The draft of the simple development plan, the text specifications and the justification are available for public inspection during general office hours at the Building Department of the Konz municipal administration, Am Markt 11, 54329 Konz, Administration Building II, Room 81. General office hours are: Monday to Thursday from 9:00 a.m. to 12:00 p.m. and 2:00 p.m. to 4:00 p.m., and Friday from 8:30 a.m. to 12:30 p.m. Appointments can also be made by telephone; the contact persons are Mr. Gerards (83-180) and Mr. Queins (83-181). Suggestions for the draft can be submitted in writing or recorded.

Pursuant to Section 44, Paragraph 5 of the latest version of the Building Code (BauGB), reference is made to the provisions of Section 44, Paragraph 3, Sentences 1 and 2, and Paragraph 4 of the Building Code (BauGB) regarding the timely assertion of any compensation claims for interference with a previously permitted use by this statute and regarding the expiration of compensation claims. The compensation claim expires if the claim is not brought to maturity within three years of the end of the calendar year in which the financial loss occurred. Pursuant to Section 215 of the Federal Building Code (BauGB), it is also pointed out that violations of the procedural and formal requirements specified in Section 214, Paragraph 1, Nos. 1 to 3 of the BauGB, significant violations of the provisions governing the relationship between the development plan and the land-use plan under consideration of Section 214, Paragraph 2, and significant deficiencies in the balancing process pursuant to Section 214, Paragraph 3, Sentence 2 are irrelevant if they have not been asserted in writing to the City of Konz or the Konz municipal administration within one year of this publication of the statute. The facts justifying the violation or deficiency must be presented.
According to Section 24 Paragraph 6 of the latest version of the Municipal Code (GemO) for Rhineland-Palatinate, it is pointed out that statutes that have been drawn up on the basis of this law in violation of the procedural and formal provisions of the Municipal Code are deemed to have been valid from the outset one year after publication.
This does not apply if
1. the provisions regarding the public nature of the meeting, the approval, the execution or the publication of the statutes have been violated, or
2. before the expiry of the period referred to in sentence 1, the supervisory authority objects to the decision or someone has notified the City of Konz or the Konz municipal administration in writing of the violation of the procedural or formal requirements, specifying the facts giving rise to the violation.
If someone has asserted an infringement under paragraph 2, anyone may assert this infringement even after the expiry of the one-year period mentioned above; the facts that are supposed to justify the infringement must be set out.
