Photovoltaic site concept - ground-mounted systems

Plants for photovoltaic systems are privileged outdoors only in certain areas. In non-privileged cases, it is necessary to draw up a development plan to establish corresponding special building areas in order to secure them under building planning law. Within the framework of municipal planning sovereignty in accordance with § 1 Para. 3 Clause 1 Building Code, the municipalities must draw up land use plans as soon as and to the extent that it is necessary for urban development and order; however, there is no entitlement to this. According to Section 8, Paragraph 2 of the Building Code, development plans are to be developed from the land use plan. Either the land use plan already represents the corresponding (special) building area as a preparatory land use plan, or it is to be changed in a parallel process (individual update) in conjunction with the process for drawing up the development plan. In Rhineland-Palatinate, the authorities responsible for planning land use planning are the associated municipalities in accordance with Section 203 (2) of the Building Code in conjunction with Section 67 (2) of the Building Code.

The Konz Association of Municipalities now has the legitimate aim of preparatory control of the establishment of photovoltaic systems in the area of the Association of Municipalities. In addition to determining the area potential that is available in the association area for photovoltaic ground-mounted systems without any resisting concerns, the concept is intended to avoid that area discussions have to take place in each individual planning (testing of alternatives).

The concept for controlling the use of solar energy in open spaces makes future planning easier: potential investors can easily see where open space photovoltaic systems are possible and where not. A time-consuming subsequent examination only after an expression of interest is not necessary. If a plant is to be realized, a change in the land use plan for the corresponding area and also a development plan are required.

The documents have now been completed. The public now has until April 24, 2023 the opportunity to make suggestions for the planning.
